Motion for a New Trial : Questions and Answers
When should I file for a Motion for a New Trial?
A Motion for a New Trial must be filed and served on the other parties no later than 14 days after the fact-finder has filed his or her decision in the case. Guidelines in Civil Rule 59 help the judge decide whether to grant the Motion for a New Trial.
What is an appeal?
A procedure in which a party to a legal proceeding asks a higher court to reverse or modify the judgment or other final order of a lower court or of an administrative agency. Appeals generally must be made on the ground that the lower court misinterpreted or misapplied the law, rather than on the ground that the lower court made an incorrect finding of fact.
