Olenik v. Huff

No. 02-COA-058 (Ashland, 5th Dist., 8/28/03) Granting of stalking CPO affirmed. Petitioners had burden of proving their entitlement to the CPO by a"preponderance of the evidence" standard that defendant is violating the menacing by stalking statute, and not a "proof beyond a reasonable doubt" standard.
