Case Summaries: Civil Protection Orders - Renewal
DV CPO Renewed Despite No New Acts of Violence:
The Fifth District Court of Appeals affirmed the trial court’s renewal of a DV CPO even though no new acts of violence had been committed since the original CPO was issued. Petitioner’s testimony that she continued to fear the respondent and feared for her safety adequately supported the renewal of the protection order. Patton v. Patton, 2010-Ohio-2096 (5th Dist., Muskingum, 5/11/2010).

Husband’s Threats Sufficient to Warrant Renewal of CPO
The court of appeals affirmed the trial court’s decision renewing the wife’s DV CPO for another four years. The husband’s actions, such as showing up unannounced at his wife’s job to harass her and leaving notes on her door and vehicle, were tantamount to threats within the meaning of the case law. The husband also sent his wife numerous threatening letters. The physical intimidation, as well as the stalking-like actions, is sufficient to support the renewal of the CPO. Owens v. Owens, 2008-Ohio-7036 (5th Dist., Richland, 12/31/08).
