State v. Dario

(Hamilton, 1st Dist., 1995), 106 Ohio App.3d 232: Evidence sufficient to establish victim's belief of impending physical harm and conviction for menacing by stalking where defendant assaulted victim, followed her, telephoned her at home and work, came to the house where she was staying, left unwanted flowers and notes, showed up at her place of employment, threatened her career, and caused her to fear for her life.

Kreuzer v. Kreuzer

(Greene, 2nd Dist., 1/11/02), No. 2001-CA-49, 2002 Ohio App. LEXIS 71: The trial court found that the victims fear was reasonable, and therefore the belief of impending physical harm element was met despite the appellants view that it was irrational in light of the lack of action causing physical harm in the past.
