This is your legal minute, brought to you by the Ohio State Bar Foundation.

Once a jury is impaneled in a trial, the attorneys get to address the jury and make what are called “opening statements.”

The plaintiff goes first, followed by the defense.

An opening statement is very much like a preview of coming attractions at the movies:

the attorneys tell the jurors what they think their case will be, what the evidence will prove.

The idea is, like in coming attractions, to tantalize a juror or wet his or her appetite for more.

Therefore, opening statements are very important to attorneys.

They set the stage for the rest of the trial.

It’s also an opportunity for the attorney to gain some rapport and credibility with the jury—this is also vitally important.

Some experts say that an attorney can win or lose his or her case to a jury within the first two to three minutes of presentation,

depending on how the jurors react.

This legal minute is brought to you by the Ohio State Bar Foundation.
