This is your legal minute, brought to you by the Ohio State Bar Foundation.

Sometimes in the news, you’ll hear that the attorneys and judge in a case are having a “pre-trial conference,”

and most people have no idea what that means.

Well, pre-trial conferences come in many forms, and may be differently handled from judge to judge.

However, generally, they are a time for the opposing attorneys to meet with the judge,

either formally or informally, to talk about issues coming up in a particular case.

Sometimes, the discussions are about certain procedures; sometimes, the conferences center on the logistics of the case—

when certain motions are due, for example, or setting a date for a trial to take place.

Often, however, pre-trial conferences are used by the attorneys and the judge as opportunities to explore settlement of a case before trial.

In a criminal case, this may be in the form of a negotiated plea in exchange for certain sentencing recommendations by the State.

In a civil case, the parties explore whether an agreed-upon sum of money

can be exchanged between the parties to resolve the disputes short of trial.

This legal minute is brought to you by the Ohio State Bar Foundation.
