              <p begin="00:00:05.90" end="00:00:13.10">Most criminal cases never reach trial.  Most are settled beforehand by what are called negotiated settlements, or negotiated pleas.</p>
              <p begin="00:00:13.20" end="00:00:19.30">These agreements commonly come under the heading of plea bargains, but that’s a bit of a misnomer.</p>
              <p begin="00:00:19.10" end="00:00:23.50">Often the agreements are really no bargains at all for the defense.</p>
              <p begin="00:00:23.60" end="00:00:30.70">A plea agreement is when both the State and the defense compromise on the way to settle a case without going to trial.</p>
              <p begin="00:00:30.80" end="00:00:37.60">A negotiated settlement may involve the dismissing of some charges in exchange for guilty pleas to others, or maybe</p>
              <p begin="00:00:37.70" end="00:00:44.80">an agreement that would allow the State to make certain sentencing recommendations to the judge in exchange for a guilty plea.</p>
              <p begin="00:00:44.90" end="00:00:51.90">Any plea agreement, regardless how strongly the prosecution and the defense agree to it, is reviewed by the judge.</p>
              <p begin="00:00:52.00" end="00:00:59.60">Ultimately, the judge must decide whether the agreement is fair and just, and whether the agreement is acceptable.</p>
