This is your legal minute, brought to you by the Ohio State Bar Foundation.

Often, you hear the term “indictment” and you may not know exactly what that means.

Well, it’s a formal felony criminal charge brought by a grand jury against an individual.

It’s a written document that contains all the charges brought against a defendant; they are called “counts,”

and more than one charge means a “multiple-count” indictment.

The indictment states the date the alleged offenses occurred,

the degree of crime charged (for example, a first-degree felony is far more serious than a fifth-degree felony).

The indictment is kept secret and out of the public eye until it’s actually served on the defendant.

If the felony is not a serious one or a violent one, the indictment may be served on a defendant by mail.

That process of delivery would be a legal document called a “summons.”

If the indictment charges a serious felony, and the defendant is not in custody,

the defendant most likely will be arrested and given a copy of the indictment.

This legal minute is brought to you by the Ohio State Bar Foundation.
