This is your legal minute, brought to you by the Ohio State Bar Foundation.

Once a Complaint or an Indictment has been served, and the defendant has entered a not guilty plea at arraignment,

then the legal maneuvering begins by both the defense and the State. One of the early parts of the criminal law process is called “discovery.”

Under a specific rule created by the Ohio Supreme Court, the defense is entitled to ask the prosecution to supply the defense with copies of critical evidence,

and, if the defense asks the prosecution for such information, the State can request the same from the defense.

What is normally swapped are lists of witnesses (along with their addresses and telephone numbers),

lists of all expert witnesses that might be called and copies of their reports.

Copies of all police reports and written witness statements attached to the police reports are also provided.

Also, the State must provide copies of all forensic data—who conducted the tests, what tests were done and the results of the tests.

Even though full disclosure is required by law, both sides often try to hold back certain critical evidence from the other.

This legal minute is brought to you by the Ohio State Bar Foundation.
