A rather easy form of discovery in a civil case is called “interrogatories.”

An interrogatory is a series of written questions exchanged between parties that must be answered under oath.

Depositions can be taken of any potential witness, but interrogatories are limited to only parties to the lawsuit.

Often the questions are very broad and very detailed.

The answers provided the opposing party with information that’s vital to the preparation of the case for trial.

The questions and answers need not be of a type that would be admissible at trial.

Therefore, the questions are often extremely personal in nature.

The answers are given under oath, and if an answer differs at trial, it could be troublesome for the answering party.

This legal minute is brought to you by the Ohio State Bar Foundation.
