              <p begin="00:00:05.70" end="00:00:12.50">A vital part of the discovery process in civil cases is a legal procedure called a “deposition.”</p>
              <p begin="00:00:12.60" end="00:00:15.60">Depositions are taken prior to trial.</p>
              <p begin="00:00:15.70" end="00:00:23.50">In short, a deposition is when a party orally asks questions of a witness who must answer those questions under oath.</p>
              <p begin="00:00:23.60" end="00:00:30.00">Sometimes, a party takes a deposition to discover what another party’s witness might have to say at trial.</p>
              <p begin="00:00:30.10" end="00:00:35.70">Sometimes a party may want to preserve the testimony of one’s own witness prior to trial—</p>
              <p begin="00:00:35.80" end="00:00:41.30">this is done when a witness is ill or may not be able to make a live appearance at trial.</p>
              <p begin="00:00:41.40" end="00:00:46.20">Depositions may be taken of any potential witness in a case.</p>
              <p begin="00:00:46.30" end="00:00:52.40">They are taken in front of an official court reporter, but they may also be tape-recorded or videoed.</p>
