This is your legal minute, brought to you by the Ohio State Bar Foundation.

Once a civil case is started by the filing of a Complaint by the plaintiff, the defendant must next be served with a copy.

That service usually occurs by certified mail.

Then, once service has been obtained, a defendant has 28 days to file with the court a written response to the Complaint.

Such a response is called an “Answer” and the legal document does exactly that—

the defendant either admits or denies the allegations in the Complaint,

and admits or denies the theories of the case, such as denying there was negligence.

This Answer sets the framework of the case—what must the plaintiff prove and what has already been admitted?

If the defendant feels he or she has a legal claim back against the plaintiff, as part of the Answer, the defendant files a Counterclaim—

that is when the defendant brings a legal action against the plaintiff.

So, in short, there are two lawsuits in one case.

This legal minute is brought to you by the Ohio State Bar Foundation.
